8. Warranty and guarantees

Unless otherwise expressly agreed below, the statutory liability for defects shall apply.

In the case of used goods, the limitation period for defect claims is one year from delivery of the goods.

The above restrictions and shortening of the period shall not apply to claims arising from damage caused by us, our legal representatives or vicarious agents in the event of injury to life, body or health, intentional or grossly negligent breach of duty and malice, in the event of a breach of essential contractual obligations, the fulfilment of which enables the proper execution of the contract in the first place and on whose compliance the contractual partner may regularly rely (cardinal obligations) within the scope of a guarantee promise, insofar as agreed or insofar as the scope of the Product Liability Act has been opened up.

Information on any additional warranties and their exact terms can be found on the product and special information pages of the online shop.

9. Liability

For claims arising from damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation in the event of injury to life, limb or health, in case of intentional or grossly negligent breach of duty, in the case of guarantee promises, if agreed, or insofar as the scope of application of the Product Liability Act has been opened up.

In the event of a breach of essential contractual obligations, the fulfilment of which enables the proper execution of the contract in the first place and on whose compliance the contractual partner may regularly rely, (cardinal obligations) due to slight negligence on the part of ourselves, our legal representatives or vicarious agents, the liability shall be limited to the damage foreseeable at the time of the contract’s conclusion, the occurrence of which must typically be expected. In all other respects, claims for damages are excluded.

10. Resolution of disputes

The European Commission provides a platform for online dispute resolutions (ODR) which can be accessed at https://ec.europa.eu/consumers/odr/. We are not obliged to, and will not partake in dispute settlement proceedings before a consumer arbitration body.
